Here's the key language from the Constitution, Article 3, Section 3:
"Clause 1: Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort...."
The definition is very narrow, very specific -- the ad in question is just hyperventilating teabaggery and silliness, not treason. It's disturbing in its outlandish insistence that something so basic as the income tax makes the government our enemy rather than our representatives, but I think it will probably do the candidate more harm than good -- it's really embarrassing stuff that will only appeal to the cartoonish base of the Republican Party.
Octo It was very close in my opinion to treason. What would have happened if someone did pick up his arms and shoot someone. This guy would say, what, not me, I never told him to do that. The same thing Sarah would probably say. If nothing else it's inciteful and a crime.
Now that you mention it, this link is interesting in that light -- acts such as sedition, insurrection, and advocating the overthrow of the gov. are referenced. I suppose that if the government wanted to prosecute people for this kind of thing, they could try, though it seems as if they don't much bother with it.
